RISK WARNING
This RISK WARNING is issued jointly by the Manning River Sailing Club
and the NSW Maritime Authority, pursuant to the Civil Liability Act
2002 to all persons wishing to participate in the sailing activities
conducted by Manning River Sailing Club.
Participants are warned that, regardless of the precautions, which
might be taken by reasonable and experienced persons, sailing can be
a dangerous pursuit and participants are exposed to significant risk
of property damage, physical harm and possibly death.
As an indication, these risks may include, but are not limited to:
- The extremes of weather and sea conditions.
- The potential that control of vessels may be lost, resulting in collision
with objects and other vessels.
- The sudden movement of the vessel at any time and the possibility
that participants may fall or be thrown overboard, resulting in drowning.
- The possibility that participants may be injured by equipment on the
vessel.
- The absence of immediate medical care and the likelihood that significant
delays may occur before medical care is available.
- Exposure to the elements for extended periods.
The Manning River Sailing Club Inc. and the NSW Maritime Authority
also warn participants that regardless of their best intentions, they
may be unable to render assistance to participants who are in distress.
Participants are warned to consider the above risks and all other risks
before deciding to participate in any sailing event with the Manning
River Sailing Club.
Participants are also advised that although the Manning River Sailing
Club Inc. is covered by third party liability insurance, this cover
DOES NOT extend to participants. Any participant who considers
they have a need for insurance must make their own private arrangements
with an insurer. A personal accident insurance policy is available with
subscription to membership of Yachting NSW.
1. RULES
1.1. The 2008-09 Sailing Season will be governed by the rules as
defined in 2005 - 2008 Racing Rules of Sailing (RRS), the Manning River
Sailing Club Inc. Sailing Instructions and the appropriate class rules.
1.2. YA Special Regulations Part 2 (Off the Beach Boats) shall
apply.
2. ADVERTISING
2.1. Refer to RRS Rule 79
3. ELIGIBILITY AND ENTRY
3.1. The regatta is open to all boats that satisfy YA Special
Regulations Part 2 (Off the Beach Boats).
3.2. Each entrant and crew shall be a financial member of MRSC
and of Yachting Australia. Attention is drawn to RRS Rule 46 and YA
Prescriptions thereto. A person may sail up to 3 races (paying casual
fees) before this requirement takes effect.
3.3. It is strongly recommended that each yacht have a risk cover
of no less than $10,000,000 by way of a certificate of currency or policy
document copy. If not produced, they will not be given entry approval
to any event other than club events.
3.4. Entry forms for 2008-09 Season shall be lodged with the
Club Registrar prior to the 31st of October 2008, with all fees due
being paid by this date.
....3.4.1. The MRSC understands
that all persons may not be able to pay all their fees by the due date.
Special Consideration may be given by the Committee on application.
Forms will be made available.
....3.4.2. Late Entries will be
accepted for the 2008-09 Season on application to Race Management.
4. SKIPPERS AND CREW
4.1. The nominated crew (as stated on the Vessel Registration
form) may substitute for the skipper in his/her absence with no change
to the vessel's prior race handicap.
4.2. If a non-crew member substitutes for the skipper, Race Management
will use their discretion to determine the vessel's handicap for that
race.
5. FEES
5.1. The Following Fees are required

to regularly sailing members. Members are not required to pay boat storage.
The fees for non-members are as follows:

....5.1.3. Due to limited storage
space, preference will be given to those members whose Sailing Fees
are paid to the MRSC. Further to this, boats that do not sail in at
least 90% of club events will not be given storage space.
6. SCHEDULE
6.1. Registration: forms can be collected and submitted from
1100 - 1200 hours on each sailing day until the end of October. After
which, special arrangements may be made for continuing payments and
late entry.
6.2. Measurement and Inspection
....6.2.1. It is the responsibility
of each boat owner to ensure that their boat complies with the measurement
rules of their class association. Protests regarding measurement will
subject the protestor's and the protestee's boat to being measured to
ensure compliance.
....6.2.2. Random measurements and
inspections may be carried out throughout the racing season at the discretion
of the Race Management and by members of the Race Management.
6.3. Dates of Racing
....6.3.1. See Attachment A (Sailing
Program) for the Schedule of Races.
6.4. The first warning signal for each MRSC club race day will
not be before 1230 hours. It is the intention of the Race Management
that races will start at approximately 1300 hours, weather and conditions
permitting.
6.5. If no warning signal has been made before 1530 hours, races
for that day will be abandoned and re-scheduled, where possible.
7. SAILING INSTRUCTIONS
7.1. The Sailing Instructions will be available on the MRSC website
after the final registration renewal date.
7.2. Sailing instructions can be collected from the registrar
when fees are paid and forms submitted.
8. VENUE
8.1. The Venue shall be the Manning River from Cundletown to
Taree in accordance with our current Aquatic Licence. (This includes
Manning Point)
9. BERTHING
9.1. Boats shall be kept in their assigned places within the
boatshed.
10. PRIZES
10.1. Prizes will be awarded at the End of Season Presentation.
10.2. The MRSC Committee will determine what constitutes a class
and what prizes will be awarded.
11. CHANGES BY MEMBERS
11.1. Forms will be made available for members to change any
of their details. Including swapping roster duties, changes to skipper/crew
of vessel etc.
11.2. Boats attending sanctioned events can fill out the appropriate
form to receive average points for the races they miss. Race Management
will decide what classes as a sanctioned event.
12. DISCLAIMER OF LIABILITY
12.1. Competitors participate in the races or regatta entirely
at their own risk. See RRS Rule 4, Decision to Race. The organising
authority will not accept any liability for material damage, personal
injury or death sustained in conjunction with or prior to, during, or
after the regatta.
